Terms of Service

1. Acceptance of Terms

By accessing and using SafeRad.io ("the Service"), you accept and agree to be bound by these Terms of Service issued by SAFERADIO PTY LTD (ABN 97 692 443 735). If you do not agree to these terms, please do not use the Service. These terms are governed by the laws of Australia.

2. Description of Service

SafeRad.io provides web-based tools for radio communication resources and training, including channel information, example calls, glossaries, practice sessions, and related exports. Features available to you depend on the product you use (including Lite and Enterprise) and any written agreement with us.

3. Training and operational use

The Service is a communications and training resource. It does not replace your site procedures, radio licences, inductions, or competent supervision. Scores and feedback may be generated in part by automated systems and are not a certification of competence. You must not rely on the Service as an operational radio, an emergency communications system, or as the sole basis for allowing a person to work.

4. User Accounts

Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

Account Security

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized use
• We are not liable for losses from unauthorized account access

5. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service for illegal or harmful purposes
• Share account passwords, or allow access except by people you are authorised to invite

6. Intellectual Property

Our Rights

The Service, including its software, design, and content, is owned by SafeRad.io and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service.

Your Content

You retain ownership of content you create or upload (including site protocols, calls, and glossaries). You grant us a worldwide, non-exclusive licence to host, store, process, and display that content solely to provide and maintain the Service, including through our subprocessors. You warrant that you have all rights needed to submit that content and that it does not infringe anyone else's rights. We may remove content that we reasonably believe breaches these terms or the law.

7. Fees and Payment

Some parts of the Service may be provided without charge. Paid subscriptions and enterprise fees are as set out in an order, quote, or other written agreement with us. We may change fees for future periods with at least 30 days' notice. Unless we agree otherwise:

• Fees are in Australian Dollars (AUD)
• You may stop using a paid part of the Service before new fees take effect

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may suspend or terminate the Service for maintenance, updates, or other operational reasons. We are not liable for any losses resulting from service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THAT, WE DO NOT WARRANT THAT USE OF THE SERVICE WILL PREVENT INCIDENTS, SATISFY A REGULATOR, OR MAKE ANY PERSON COMPETENT ON THE RADIO.

10. Limitation of Liability

To the maximum extent permitted by Australian law, SafeRad.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under Australian law, including the Australian Consumer Law. Except for that non-excludable liability, our total liability arising out of or in connection with the Service is limited to the fees you paid us for the Service in the 12 months before the claim, or AUD 100 if you have paid no fees.

11. Indemnification

You agree to indemnify SAFERADIO PTY LTD against claims, damages, losses, and reasonable legal costs arising from: (a) your use of the Service; (b) content you or your users submit; (c) your breach of these terms; or (d) use of accounts or links you issue — except to the extent caused by our fraud or wilful misconduct.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the State or Territory in which SAFERADIO PTY LTD has its registered office.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
